David R. Medlin

Dave is of Counsel to the firm. His practice is dedicated to the representation of mortgage bankers and industry professionals. Dave has more than 35 years of experience as a real estate attorney. He counsels clients on regulatory compliance and licensing under the California Residential Mortgage Lending Act, the California Finance Lenders Law and California’s Real Estate Law. He also has broad experience in federal issues involving Dodd-Frank, the Real Estate Settlement Procedures Act, HUD/FHA rules and regulations, Truth-In-Lending Act, Federal Privacy (Gramm-Leach-Bliley Act), Equal Credit Opportunity Act, the Home Ownership Equity Protection Act (Section 32) and related California laws.

Dave's practice focuses on drafting and negotiating a wide array of agreements common in the mortgage industry, from correspondent and wholesale broker agreements, to warehouse and other credit facilities, to affiliated business arrangements and branch office structures, to specialized disclosures, notes, deeds of trust and other loan documents. He also regularly counsels clients regarding general business matters collateral to the mortgage industry, including sales and acquisitions and entity formation. A significant component of Dave's practice involves negotiating and settling indemnity and repurchase claims of investors and aggregators.

Dave is admitted to practice in the State of California and is a member of the Business and Real Estate Sections of the California State Bar. He is also admitted to practice in the U.S. District Court for the Northern, Eastern and Central Districts of California. Dave is a member of the Mortgage Bankers Association, the California Mortgage Bankers Association, the California Association of Mortgage Professionals, and the Alameda County Bar Association. Dave is a frequent lecturer at seminars and conferences sponsored by mortgage industry trade associations and professional organizations.

Dave received his B.A. from the University of California, Berkeley in 1974 and is a 1977 honors graduate of the Santa Clara University School of Law.
